be deferred for such time as mutually agreed by the Supplier and the Purchaser

in order to reinstate the work and to purchase and obtain the delivery

of all materials, equipment, machinery, engines or components in substitution

for those damaged.

违 约

44．如果深舱货轮未在投标书或合同规定的时间内交付或供货，招标委员会主席将在不排除对违约作其他补救的情况下，保留终止合同的全部或违约部分的权力。

45．一旦违约，主席将保留从其他来源订购相同或类似深舱货轮的权利，以弥补违约所造成的损失。

46．因违约造成的超出招标价格的一切费用，应由供方负担。

EFAULT OF CONTRACT

44．Should the delivery or supply of any DHCS not be completed within the

time or times specified in the tender or contract, the Chairman reserves

the right, without prejudice to any other remedy for breach of contract,

to terminate the contract either wholly or partially in default.

45．In case of default, the Chairman reserves the right to order from alternative

sources DHCS of the same or similar description to make good such default.

46．Any excess of the new price over the tendered price appropriate to such

default shall be recoverable from the Supplier.

履约保证金

47．中标人应在收到中标书后两周内，自费取得有信誉银行（需经主席批准）出具的履约保证金担保，履约保证金额为合同金额的5%，以保证按时履行合同。如果合同金额明显增加，主席可要求另外增加一份保证金。

48．银行保函的有效期应以规定的交货期或双方同意的延长期为止。每交付一艘深舱货轮，银行保函的金额应按比例减少。

PERFORMANCE BOND

47．The successful tenderer shall, within two weeks of the issue of a Letter

of Acceptance, at his own expense obtain in the form of a performance Bond,

the guarantee of a reputed bank（to be approved by the chairman）in a sum
