（a）0.5节或不到0.5节——单价的1%。

（b）大于0.5或至1节（包括1节）——单价的5%。

（c）大于1节至2节（包括2节）——单价的10%。

（d）大于2节最多3节——单价的15%。

LIQUIDATED DAMAGES FOR SPEED REDUCTION

42．The Supplier should agree to pay liquidated damages on the under-mentioned

scale for any speed reduction, if the DHCS fails to reach maximum speed

as per specifications:

（a）0.5 of a knot or less—one percent (1%) of unit price.

（b）More than 0.5 to 1.0 knot inclusive—Five percent (5%) of Unit Price.

（c）More than 1.0 to 2.0 knots inclusive—Ten percent (10%) of Unit Price.

（d）More than 2.0 knots to a maximum of 3.0 knots—Fifteen percent (15%)

of Unit Price.

退 款

43．如果任何一艘深舱货轮因任何原因造成全损或严重损坏，买方有权作出抉择：或让供方继续履行合同，或终止合同。如终止合同，则供方应将按合同规定已支付的款项全部退还给买方。凡已装船或尚待装船的所有材料、调和、机器、引擎或部件因任何原因遭到严重损坏，投标书中规定的交船日期应推迟到双方共同商定的日期，以便重新施工，并购得所有材料、设备、机器、引擎或部件，以替换已损坏的部分。

REFUND OF MONEY

43．Should any DHCS, by any cause, become a total loss or should any of

them be seriously damaged by any cause whatsoever, the Purchaser may at

his sole discretion select either to have the contract fulfilled by the

Supplier or determine this contract void. In the event the contract is

determined void, the Supplier shall refund to the Purchaser all money paid

under contract. If any or all of the materials equipment, machinery, engines

or components built or to be built into the DHCS be seriously damaged by

any cause whatsoever, the delivery date of the DHCS specified herein shall
