in the opinion of the Purchaser, too slow to ensure completion by the prescribed

time or extended time for completion, the Purchaser shall so notify the

Supplier in writing and the Supplier shall thereupon take such steps as

are necessary and the Purchaser may approve, to expedite progress so as

to complete the work or such section by the prescribed time or extended

time. The Supplier shall be entitled to any additional payment for taking

such steps.

迟交违约赔偿金

41．如果供方因增加工作量、进行修改或改进而在规定时间内，或买方规定的延长期内，或供方因无法避免的原因并经买方书面同意而进一步延长的期内仍未能建成或交付每艘深舱货轮，则供方应向代表招标委员会主席的买方每月支付每艘深舱货轮价格的1%作为违约赔偿金，但不作罚款论。如能证明延误是从方不可避免的、无法预见的或无法克服的，则买方可以同意将原定的交船日期向后推延。

LIQUIDATED DAMAGES FOR DELAY

41．If the Supplier fails to construct and deliver each DHCS within the

prescribed time or within such extended time or times as fixed by the Purchaser

for executing any additional work, alterations, amendments or modifications,

or within such further extensions of time as may be granted by the Purchaser

in writing for reasons of unavoidable delays on the part of the Supplier,

then the Supplier shall pay to the Purchaser on behalf of the Chairman

of the Tender Board one percent (1%) per month, as liquidated damages and

not as penalty, of the unit price for each DHCS. Provided that it is proved

that any delay has arisen from causes which were unavoidable and could

not have been foreseen or overcome by the Supplier, the Purchaser may then

grant such period of time beyond the scheduled date.

减速违约金

42．如果深舱货轮未能按性能规格要求达到最高航速，则供方应同意按下列速度降低的比例支付违约赔偿金：
